Please read these Terms and Conditions carefully before using our website or applying to our rent-to-own program. By accessing our website or submitting an application, you agree to be bound by these terms.

1. About Rent The Key To Own

Rent The Key To Own is an Alberta-based rent-to-own real estate program operated by Bernhard and Miranda, helping families across Alberta work toward homeownership. Our program connects tenant-buyers with homes through a structured lease and option to purchase agreement.

2. Website Use

By using our website at rentthekeytoown.com, you agree to:

  • Use the website only for lawful purposes
  • Not attempt to gain unauthorized access to any part of our website or systems
  • Not use the website in any way that could damage, disable, or impair its operation
  • Not copy, reproduce, or distribute our content without written permission
  • Provide accurate and truthful information when submitting any forms or applications

3. Program Eligibility and Application

Submitting an application or inquiry does not guarantee acceptance into our rent-to-own program. Acceptance is subject to:

  • A minimum credit score of 480
  • Verifiable and stable household income sufficient to support program payments
  • Availability of an Initial Option Consideration (deposit) of 3.5% to 15% of property value
  • Satisfactory personal and financial background review
  • A realistic timeline to qualify for a mortgage within 2 to 4 years
  • Approval at our sole discretion based on program criteria

We reserve the right to decline any application without providing a reason.

4. The Rent-to-Own Program

4.1 Two Monthly Payments

Accepted participants make two separate monthly payments: rent at fair market value, and a Monthly Option Consideration that accumulates toward the future down payment. These are distinct obligations and both must be paid on time each month.

4.2 Lease Agreement

Participants enter into a residential lease agreement governed by the Alberta Residential Tenancies Act. As tenant-buyers, participants are first and foremost tenants and are subject to all applicable provincial tenancy laws.

4.3 Option to Purchase

A separate option agreement gives the tenant-buyer the right - but not the obligation - to purchase the property at a pre-determined price at the end of the program term. The option is not transferable and may not be exercised early without our written consent.

4.4 Property Maintenance and Repairs

Tenant-buyers are responsible for all repairs and day-to-day maintenance of the property including lawn care, snow removal, and general upkeep. Minor repairs may be carried out without prior approval. Any larger or significant repairs must be approved by us in writing before work begins.

4.5 Rent Review

Rent is reviewed on a year-to-year basis in accordance with the Alberta Residential Tenancies Act and applicable regulations.

4.6 Option Consideration

The Initial Option Consideration (deposit) is not fully refundable. If the tenant-buyer chooses not to exercise the option to purchase or is removed from the program due to breach of agreement, the Initial Option Consideration may be forfeited in whole or in part as outlined in the option agreement.

5. No Mortgage or Legal Advice

The information on our website and provided during consultations is for general informational purposes only. It does not constitute legal, financial, mortgage, or investment advice. We strongly recommend that all participants seek independent legal advice (ILA) before signing any agreements, and consult a licensed mortgage broker regarding their specific financial situation.

6. Intellectual Property

All content on this website including text, images, logos, graphics, and design is the property of Rent The Key To Own and is protected by Canadian copyright law. You may not reproduce, distribute, or use any content without our prior written permission.

7. Limitation of Liability

To the fullest extent permitted by law, Rent The Key To Own and its founders shall not be liable for any indirect, incidental, or consequential damages arising from your use of our website or participation in our program, including but not limited to changes in property values, changes in mortgage lending rules, or failure to qualify for financing at the end of the program term.

8. Program Changes and Market Conditions

Real estate markets and mortgage lending rules can change during the course of a program term. We cannot guarantee that participants will qualify for a mortgage at the end of their term, as approval depends on factors outside our control including lender policies, interest rates, and government regulations. We will make every reasonable effort to support participants in achieving their homeownership goal.

9. Privacy

Your use of our website and program is also governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference.

10. Governing Law

These Terms and Conditions are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Alberta.

11. Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or program after changes constitutes your acceptance of the updated terms.
